Terms & Conditions

1. The Platform

WeBuyMotorcars ("we", "us", "Platform") operates an online vehicle marketplace at webuymotorcars.co.za that connects vehicle dealers and private sellers ("Sellers") with prospective buyers ("Buyers"). We are an intermediary and are not a party to any transaction between Buyers and Sellers.

2. Eligibility

• You must be 18 years or older to register an account.
• Dealer accounts must represent a legitimately registered business operating in South Africa.
• You may not create multiple accounts for the same individual or business.
• We reserve the right to refuse registration at our sole discretion.

3. Accounts

You are responsible for maintaining the confidentiality of your login credentials. You accept full responsibility for all activity that occurs under your account. Notify us immediately at info@webuymotorcars.co.za if you suspect unauthorised access.

4. Listings

• All vehicle listings must be accurate, truthful, and not misleading in terms of the CPA Section 41.
• Sellers warrant that they have the legal right to sell any vehicle listed.
• Listings must include accurate pricing in South African Rand (ZAR).
• Prohibited listings include: stolen vehicles, writeoffs listed as roadworthy, fraudulent or duplicate listings, and vehicles outside South Africa.
• We reserve the right to remove any listing without notice that violates these Terms or applicable law.

5. Dealer Subscriptions

Dealer accounts require an active subscription to list vehicles. Subscription fees, limits, and features are set out on our Pricing page and are subject to change with 30 days' notice.

• Subscriptions are billed in advance on a monthly or annual basis.
• Payments are processed securely via Yoco.
• Failure to maintain an active subscription will result in listings becoming inactive.

6. Buyer–Seller Transactions

All negotiations, agreements, and transactions regarding vehicles occur directly between Buyer and Seller. WeBuyMotorcars:

• Is not a party to any sale agreement between a Buyer and Seller
• Does not guarantee the accuracy of any listing or the condition of any vehicle
• Does not hold funds or facilitate payment between Buyers and Sellers
• Is not liable for any loss arising from a transaction between a Buyer and Seller

Buyers are advised to conduct their own due diligence, inspect vehicles, and verify ownership before concluding any purchase.

7. Prohibited Conduct

You may not use the Platform to:

• Post false, misleading, or fraudulent content
• Infringe any third-party intellectual property rights
• Harvest personal information of other users
• Introduce malware or attempt to compromise the Platform's security
• Circumvent any subscription or access controls
• Engage in any conduct that violates South African law

8. Intellectual Property

All content on the Platform including design, code, text, and graphics is the property of WeBuyMotorcars or its licensors. Vehicle photos uploaded by users remain the property of the uploader; by uploading you grant us a non-exclusive licence to display them on the Platform.

9. Limitation of Liability

To the maximum extent permitted by law, WeBuyMotorcars shall not be liable for any direct, indirect, incidental, or consequential loss arising from your use of the Platform, including but not limited to losses arising from vehicle transactions, reliance on listing information, or Platform downtime.

10. Governing Law

These Terms are governed by the laws of the Republic of South Africa. Any disputes shall be subject to the jurisdiction of the South African courts.
