1. Marketplace Intermediary

WeBuyMotorcars (webuymotorcars.co.za) is an online intermediary marketplace that connects vehicle Sellers (dealers and private sellers) with prospective Buyers. We do not own, sell, inspect, or take possession of any vehicles listed on the Platform. We are not a vehicle dealer and do not hold a vehicle dealer licence.

2. Listing Accuracy

All vehicle listings, including descriptions, photographs, pricing, mileage, condition, and specifications, are provided solely by the Seller. WeBuyMotorcars:

• Does not verify the accuracy or completeness of any listing
• Does not inspect or test-drive any vehicle listed
• Does not confirm ownership or the absence of finance, liens, or encumbrances
• Does not verify that a vehicle has not been reported stolen, written off, or rebuilt

Buyers are strongly encouraged to:

• Conduct a vehicle history check (e.g. TransUnion VIN check) before purchasing
• Physically inspect the vehicle before concluding any agreement
• Use a qualified mechanic for an independent assessment
• Verify ownership through the National Traffic Information System (eNaTIS)

3. No Warranty

The Platform and all content on it are provided on an "as is" basis without any warranty of any kind, express or implied, including but not limited to warranties of accuracy, fitness for a particular purpose, or non-infringement.

4. Transactions Between Buyers and Sellers

Any agreement concluded for the purchase of a vehicle is solely between the Buyer and Seller. WeBuyMotorcars is not a party to, and accepts no responsibility for, any such transaction including disputes about vehicle condition, title, payment, or delivery.

5. Pricing

Vehicle prices displayed are set by the Seller and are subject to change without notice. Prices are indicative and do not include registration fees, finance costs, insurance, or other charges unless expressly stated in the listing.

6. External Links

The Platform may contain links to third-party websites. These are provided for convenience only. We have no control over third-party content and accept no responsibility for any material found on linked sites.

7. Limitation of Liability

To the fullest extent permitted by South African law, WeBuyMotorcars and its directors, employees, and agents shall not be liable for any loss, damage, or expense — whether direct, indirect, or consequential — arising from:

• Reliance on any listing information
• A transaction concluded between a Buyer and Seller
• Unauthorised access to your account
• Interruption or unavailability of the Platform

8. Governing Law

This disclaimer is governed by the laws of the Republic of South Africa. Nothing in this disclaimer limits any statutory rights you may have under the Consumer Protection Act 68 of 2008.
